RENTAL TERMS AND GENERAL INFORMATION

Rental and travel conditions:
The rental contract is concluded by us on behalf of and for the account of the respective owners, in the capacity of an agent, at the prices set by the owners. A booking/reservation is only possible in writing (e.g. online booking form, fax, mail etc.) and only becomes binding with our written booking confirmation. No verbal agreements have been made. Changes or additions to these general terms and conditions must be made in writing. This also applies to any amendment of these provisions, their mutually agreed cancellation or the waiver thereof. The tenancy agreement is purely governed by private law. Italian tenancy law is expressly agreed. Neither the landlord nor the agent is a tour operator, so that in no case the travel law § 651 a BGB applies. An intermediary contract is concluded between you and us. We are not an organiser, but merely have the position of an intermediary between you and the respective host. The hosts/landlords of the holiday homes provide their services to you on their own responsibility in the form of a rental relationship. The agency contract with us is not a travel contract within the meaning of travel contract law. According to § 312g paragraph 2 sentence 1 No. 9 BGB there is no right of withdrawal. Please refer to the booking form for the respective contractual partner and its address. Our rights and obligations arise from these terms and conditions. Please check the documents received from us for correctness regarding the location, accommodation, price and rental period and inform us promptly of any errors, mistakes or missing information. The deposit in the amount indicated for the respective object is due within 7 days after receipt of the booking confirmation. In case of non-receipt or incomplete receipt of the deposit within this period, we are entitled to declare the cancellation of the rental contract in the name and on behalf of the landlord. We expressly point out that in the event of cancellation of the rental contract, a claim for at least the amount of the deposit remains (see also cancellation conditions below). The remaining amount is due as stated for the respective object. Bank charges are not covered by us. For changes after conclusion of the rental contract regarding the travel date of the respective booked object (rebooking), an amount of EURO 30.00 will be charged. The prerequisite for this is that the rebooking lies within the temporal scope of the offered dates of occupancy and the rebooking request is feasible (max. up to 60 days before the start of the rental period of the originally booked object and in each case for the same year, a carry-over into the next year is not possible). The services offered by us are exclusively the mediation of external services. The place of performance and jurisdiction is the respective location of the rental object or, if otherwise applicable, the owner’s place of residence. If the contract has to be changed or cancelled for reasons of force majeure or breach of contract by third parties, our liability is limited to the reimbursement of amounts already paid.
Rental contract / travel cancellation:
The rental contract with the landlord comes into effect with the receipt of the deposit. In case of non-fulfilment of the contract, the landlord is entitled to withdraw from the rental contract or to claim damages for non-fulfilment. Should you withdraw from your booking and we are unable to find a replacement person to take over the property you have booked, the landlord will generally charge the following cancellation fees:
Cancellation up to 40 days before the start of the holiday: The deposit remains with the landlord.
After that: 100% of the rental price
When booking, I recommend that you take out travel cancellation insurance so that you are also covered in the event of a trip cancellation. In some places here in Tuscany a tourist tax is required. Unfortunately, there are no uniform rules and they change all the time. Each town decides for itself whether and how much this tax is levied. In holiday homes, the price is usually 1-2 euros per day and person.
Arrival and departure:
The rental contract states from what time the rented holiday home is available to you on the day of arrival. You will also be told by what time at the latest you must have left the house on the day of departure. Please note that it is not possible to hand over the keys earlier. Between each change, the holiday home will be checked and small repairs may need to be carried out to ensure that you find the house in a satisfactory condition.
Deposit:
The rental agreement will state how much the deposit is, which you pay in cash on arrival.
Highchair, cot:
It is possible to get a child’s bed and chair in almost all houses. Please ask for it when booking.
Health insurance:
We recommend that you bring an appropriate EU health insurance card (blue).
Smoking:
If smoking has taken place in a non-smoking house, we will charge the tenant for the necessary cleaning. Please contact the person in charge of your arrival a few days before arrival to communicate an approximate arrival time and on the day of arrival about 2 hours before arrival the exact arrival time. Almost none of the landlords speak German, some speak a little English. If you have any problems, just call me and I will translate.
Approach to the holiday property:
At some properties it may be possible that the last part of the approach consists of gravel or unpaved road or is very steep. In this case, watch out for potholes etc. Arrival with certain vehicles, such as convertibles, lowered cars, motorbike or boat trailers, etc., is then in some cases not possible or only with difficulty. Please inform yourself in advance if you plan to arrive with such a vehicle. Gravel roads are sometimes still normal roads in Tuscany and even public roads are sometimes not tarred.
Directions:
Can be created on Google Maps. If you get a photo description from Tuscany Exclusive it means that Google cannot reliably find these houses.
Construction noise:
Under certain circumstances there may be construction noise in the vicinity during your holiday. Neither Tuscany Exclusive nor the house owner can know when and where construction or renovation is taking place and therefore cannot be held liable for this.
Final cleaning:
Is included in the final price in the rental contract, but is often paid in cash on site. You only have to clean up in the house and on the property, wash the dishes or empty the dishwasher before you leave the house. Bottles and cans, as well as rubbish that does not fit in the rubbish bin, must be removed before departure. If an intermediate cleaning is provided, it is compulsory.
Allergy sufferers:
Even if the house description states “Pets not allowed”, it is possible that the homeowner or their guests have brought pets into the house. Tuscany Exclusive or the homeowners do not accept responsibility for allergic reactions of any kind.
Guests:
We would like to draw your attention to the fact that NEVER more persons are allowed to stay in the holiday home than are indicated in the house description. It is also not permitted to set up tents, caravans or motor homes on the property of the rented holiday home.
Bed linen and towels:
Bed linen and towels are partly included, partly they can be brought or rented. Please refer to the house description for more information. Kitchen towels and cloths are not normally provided and must be brought along. Towels for swimming (pool/sea) must also be brought by yourself.
Equipment and furnishing:
The furnishings and equipment are the taste of the owners, who are usually very proud of their accommodation. Keep in mind that Italian houses are equipped differently than in your home country. For example, Italians only drink espresso and the coffee machine is usually a moca (small Italian coffee machine) that you put on the cooker. Italians drink wine from normal water glasses and not all landlords are considerate of foreign guests who are used to wine glasses. The blankets on the beds are loosely wrapped in sheets and not completely covered. And various other differences.
Bed/bed spaces/closets or storage space:
Bed sizes vary a lot. The width of double beds varies between about 120-180 cm. The length varies between 175-200 cm. (Standard for a double bed in Italy is 160x190cm). The width of single beds varies between 60-85 cm and the length between 175-200 cm. (Standard in Italy is 80x190cm). The double beds are often equipped with a large mattress, sometimes with two single mattresses. Often the owners have put an extra cover over the mattresses for reasons of hygiene and appearance. Please put your own bed sheet OVER this cover. Please note that there are generally not enough cupboards or storage space in the properties. Therefore, you cannot assume that your clothes can be completely placed or hung in the existing cupboards. Some wardrobes are open or have only a curtain.
Travelling with pets:
Pets are welcome in several of our cottages, but first read the cottage description for that cottage carefully before arriving with your pet and always register the dog with breed at the time of booking. If you bring pets with you, they must not be left unattended in the house and animals are not allowed in or on the furniture. On departure, the property must be cleaned so that there is no dog excrement lying around. In the description of the individual houses it is stated whether a pet can be brought along. In any case, please let us know that you are bringing a pet.
A few rules, dogs are not allowed
- on the bed/sofas
- not in the swimming pool
- kitchen utensils are not to be used as feeding bowls
if this is not observed, an extra cleaning fee will be charged by the landlord on departure.
Mobile phone reception:
In Tuscany there is often no or limited mobile phone reception, especially in rural areas and in houses outside the towns. If mobile phone reception is important to you, I will be happy to tell you whether there is mobile phone reception in the holiday home you have chosen.
Power and water failure:
In Italy, and therefore also in Tuscany, it can happen that the water runs out and is cut off completely for a few hours. In case of heavy rain or wind or in case of overload (households have 3kwh at their disposal), the electricity may also fail in rare cases. The residents of the village have to put up with these circumstances just like our customers. In none of these cases can reduction rights be claimed.
Internet:
Internet is available in almost all houses. If this does not work, do not be angry with us, but with the provider. But again, you cannot claim a right of reduction. In some houses, especially in the countryside, there is very slow internet and only to a limited extent. It is always true that the internet is not suitable for downloading films or playing games online.
Television:
There is satellite TV in most houses, but this does not always ensure reception of German channels. Italian and German channels are on different satellites. If German or other language TV channels are indicated in the description, this does not mean that you have the same programmes available as at home. Some houses have access to German or other languages programs via Internet and sometimes provide providers such as Netflix or you can log in to your account for the duration of your holiday.
Swimming pools:
The swimming pools are open from mid-May to the end of September, depending on weather conditions. The water is not heated unless otherwise stated. For safety reasons, it is not allowed to jump into the water from the edge of the pool. In some agriturismo there are times of use for the swimming pool. Animals are not allowed in the pool.
Heating:
Heating in Italy cannot be compared to German heating. Flats and houses can be damp, especially in the cold season, due to the country’s typical climate. As energy costs in Italy are much higher than in Germany, please assume that heating costs can be correspondingly high. In the countryside, where heating is partly done with gas from the tank in the garden, costs of over Euro 20/day may well arise. In some houses it is normal for central heating to be via the chimney connected to the various radiators. The heating period is fixed by law from the beginning of November to the end of April.
Prices:
The respective rental prices are weekly prices (generally from Saturday to Saturday) and stated per rental property, not per person, unless otherwise stated in the property description. In the low season, arrival and departure can also take place on other days. And often it is possible to book shorter than one week. Just contact me. The number of persons and pets stated in the booking confirmation must not be exceeded.
Bugs/Insects:
Special attention is drawn to the fact that Tuscan holiday homes are mostly located in natural areas. Naturally occurring insects such as ants, flies, spiders and the like can occur in these natural areas. Nothing can be done against this. If the insect infestation in the holiday home is extreme, contact the owner on site. He will then do our best to help you.
Washing machine-dishwasher:
In many houses there are washing machines and/or dishwashers. Should operating faults occur, repair cannot be guaranteed on weekends or evenings. In case of malfunctions on the part of the tenant, Tuscany Exclusive reserves the right to have the repair carried out at the expense of the respective tenant. Please always read the instructions for use or call the owner if you have any doubts about the operation.
Whirlpool (where there is a whirlpool in the house):
Hygiene in the whirlpool is very important. For this reason, we ensure that the whirlpools are thoroughly cleaned every time there is a change of tenants in order to combat bacteria. If the whirlpool is used, you must clean it after use with the special cleaning agent provided. Please only switch on the whirlpool when the water is 10-15 cm above the jets.
Electricity – water – gas:
Are included in the price for some holiday properties, for others, especially for properties with air conditioning or other systems that use a lot of electricity, they are often charged according to consumption. This is always stated in the property description. We recommend that you check your energy consumption from time to time during your holiday in case it is charged extra. In Italy, private houses have 3 kwh, which means that only one energy-intensive appliance can be used at a time. On arrival, ask to be shown where the main fuse is. Bring adapters with you, there are not always any available in the holiday home.
Electric car:
If you are travelling with an electric car, ask us in advance where there are charging stations near the holiday home. Charging in/at the holiday home is generally not possible and also not permitted.
Liability:
The description of the objects was created to the best of my knowledge, according to information provided by the owners and checked by me personally. Liability for unauthorised changes to the rental property after the description has been prepared is excluded.
Rubbish:
In some communities the rubbish is collected on site on different days. You will find the information about this in the house. In other communities there are still the large containers along the road, where paper, glass-plastic-metal, residual waste is separated.
Distances:
All distances were measured on the internet on Google Earth and are given as the crow flies. They have been compiled to the best of our knowledge, but without guarantee of accuracy.
Garden furniture:
Garden furniture is available in all holiday homes, i.e. table and chairs. Almost always also parasols and deckchairs. Cushions, on the other hand, are often not provided. Please refer to the house descriptions for the equipment
Plot:
The plots are rarely fenced. Please refer to the house description to see if this is the case.
General:
We are not liable for any influence on the rental object due to force majeure, e.g. strike, war, power and water failures customary in the country or bad weather conditions. If the use of the rental object is not possible due to force majeure and no equivalent replacement object can be procured, liability shall be limited to a maximum of the amount of the payments already made by the customer. Further claims are excluded. The use of the property including all associated outdoor facilities is at the customer’s own risk, the landlord and Tuscany exclusive accept no liability in the event of accidents. No claims for compensation can be asserted. The customer is responsible for his own property and valuables as well as cash brought along, the landlord and “Tuscany Exclusive” do not assume any liability in case of burglary. All possible recourse claims of the tenant are to be made to the respective owner or his representative immediately on site. The respective address can be provided if necessary. All other complaints about the rented property and claims for replacement must be reported immediately to “Tuscany Exclusive” in writing.
Damages:
The tenant must treat the rented property together with the inventory with care and is personally liable for any damage caused by him/her and his/her co-inhabitants. Damage must be reported immediately to the owner and/or “Tuscany Exclusive”. We ask you to report any complaints immediately (within 24 hours) to the landlord during your stay so that they can be rectified directly. Likewise, any damage caused by you, for which you as the tenant are liable, should be reported immediately to the landlord. A copy will always be sent to Tuscany Exclusive as well.
Duty to cooperate:
The tenant is obliged to check the inventory of the rented property on arrival and, if necessary, to report any damage to the owner/manager within 24 hours so that remedial action can be taken. Tuscany Exclusive must be informed in copy. Complaints submitted later cannot be considered. The rental properties are often surrounded by gardens, you must expect ants, mosquitoes and other small animals (in the countryside e.g. also field mice). This does not constitute a defect, therefore no claims for compensation can be made.
